These general conditions of sale come into effect, for one part, for Padyma SARL, rue des basques, 24360 Varaignes, registered at RCS in Périgueux under number 492.356.423 and for the other part, by any and all legal persons wishing to carry out a purchase via the internet site: www.padyma.com.

1 – Purpose
These conditions of sale are intended to define the contractual relations between Padyma and the customer.
The acquisition of goods from this site indicates unreserved acceptance of these conditions of sale by the customer.
If a condition should fail to be stated, it will be considered to be governed by the current practices in the remote sales sector where the companies are based in France.
Padyma reserves the right to change these conditions of sale at any time. Should this occur, the applicable conditions will be those that are current at the date of the customer’s order.
2 – Prices
All the prices of items are stated in euros, including all taxes for within the European Union and excluding tax for other countries (see paragraph 3). Padyma reserves the right to change prices at any time without notice. Items are billed according to the prices that are current at the time that the orders are registered. Items remain the property of Padyma until the full collection of payment by Padyma.
3 – Customs Information:
Dispatches to the European Union (no customs charges):
The free circulation of merchandise without specific custom’s requirements applies between the 25 member countries of the European Union. Consequently, no custom’s document need be attached and there is no Customs Charge.
Countries of the European Union: Austria, Belgium, Czech Republic, Southern Cyprus, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxemburg, Malta, the Netherlands, Poland, Portugal, Slovakia, Slovenia, Spain, Sweden, the United Kingdom and Northern Ireland.
We bill your order with all taxes included, with V.A.T of 19.6%
DOM-TOMs – Overseas Territories:
The DOM-TOMs are territories that are distinct in fiscal terms from the member states of the European Union.
Sending goods by post outside of mainland France to these overseas departments or territories is therefore considered as the exportation of items. Consequently, the person sending from mainland France is subject to the laws of exportation – we bill your order with no taxes included.
Overseas Freight Cost
In the regions of Guadeloupe, Guyana, Martinique and Reunion, the Overseas and regional freight costs are payable.
VAT applies in Martinique, Guadeloupe and Reunion with the same conditions as in mainland France, but at a reduced rate of 8.50%.
When your parcel is received you need to pay the overseas freight cost and the VAT at a reduced rate of 8.5%, with the understanding that certain exceptions are allowed.
Switzerland, United States, Africa, Asia
The applicable laws and taxes are normally those that belong to each country and may, beyond the customs laws, add consumption taxes similar to V.A.T. It is therefore not possible to state all the applicable laws.
Each order that comes through the site will be subject to the taxes and customs laws that are in place when the parcel reaches its destination. These customs laws and taxes pertaining to the delivery of items are to be charged to you and are your responsibility. We are not liable to check or inform you of the customs laws and applicable taxes. In order to find out what these are, we would advise you to contact the relevant authorities within your country.
For example: Switzerland VAT 7.6% to 12.4% with a theoretical duty-free threshold of 100 CHF for gifts.

4 – Order
Customers may order over the internet via the site www.padyma.com
Padyma reserves the right to cancel or refuse any order from a customer with whom there is a dispute regarding the payment of a previous order.
Each order confirms acceptance of the price and description of the products available for sale.
Padyma shall only undertake to honour the orders received on their website within the limits of the available stock of products. Should a product not be available, Padyma shall attempt to let the customer know as soon as possible.
5 – Delivery
There are two types of delivery:
Colissimo Suivi for within France (standard)
Chronopost for other countries (costs vary according the destination country)
Delivery times are average times according to the time required for processing and delivery and do not include bank holidays and weekends.
Delivery is available worldwide.
In the case of payment by cheque (France only) the order will not be processed until the cheque is received. Consequently, the order processing times in these cases will be from the day of the receipt of the cheque and may be different from those stated on the day that the order was placed.
Padyma undertakes to exchange products that appear to be defective, or products which are of a size that was not stated in the order, within 7 days. In these cases, customers can make a returns request by filling in a form in the “My Account” section. Padyma will proceed to exchange the goods, or provide reimbursement by cheque. Goods must be returned in the same condition as the customer received them, with all the elements that were delivered (accessories, original packaging, letter…).
6 – Payment
Payment for your purchases can be made:
By credit card via secure payment: Visa, MasterCard, Carte Bleue debit card.
By cheque made payable to “SARL Padyma” (France only)
The processing of the cheque is carried out upon receipt.

7 – Features and availability of the proposed products
The proposed products are those which are published on the website www.padyma.com . Our offers are valid for as long as they appear on the site and only within the limits of available stock.
The catalogue photographs are not contractual: they are the most faithful possible but cannot guarantee identical resemblance to the offered product, particularly as far as colour is concerned, which is dependant on your screen’s settings.
Upon receipt of your order, we will check the availability of the product(s) ordered. In the case of unavailability the whole of the amount paid will be refunded to you.
8 – Responsibility
At all stages of access to the site, for the processing of order, for delivery or after-sales services, Padyma only has an obligation of means. Padyma is not liable for any inconvenience or damage incurred through the use of the internet, particularly through an interruption of service, an intrusion or the presence of computer viruses, or any fact that qualifies as force majeure, in accordance with jurisprudence.
The items sold are described and presented on the site with the greatest precision. If, despite our precautions, errors have appeared on the site, we cannot in any case be held liable for this fact. Except in the case of a guarantee, no transactions between Padyma and its customers, not contested within the 7 days from delivery, may give rise to a claim.
9 – Nominative data
Information and data about you are necessary for the management of your order and for our business relationship. In accordance with the law on information technology and freedom of 6th January 1978, you have a right of access to and correction of your personal data. Simply write to us online stating your name, surname, email and address. Our site has been designed to be especially attentive to our customers’ needs.
10 – Intellectual Property
All the elements of the website www.padyma.com are and remain the exclusive intellectual property of Padyma. For this reason and in accordance with the intellectual property code, only private use is authorised, under the restrictions of various provisions, even more restrictive than the intellectual property code. Any whole or partial reproduction of the website www.padyma.com is strictly forbidden.
11 – Relevant law and jurisdiction
This contract is subject to French law. In the case of litigation, the French courts will be the sole jurisdiction.
